Terms and Conditions
Authority of Shipper: The Shipper warrants that it is the legal owner of the vehicle, or that it has been duly authorized by the legal owner to enter into this Agreement and tender the vehicle for transport.

Cancellation
If the Shipper cancels the order, the Shipper shall pay WAC a non-refundable cancellation fee of $100.00, in addition to any other amounts owed under this Agreement.

Payment Liability
Upon tender of the vehicle to WAC or its agent, and upon acceptance of delivery by the consignee, the Shipper and consignee shall be jointly and severally liable for all charges due, including but not limited to freight charges, COD amounts, advances, disbursements, and reasonable attorney’s fees incurred in collecting unpaid amounts.

COD Payments
Unless the shipment has been prepaid or other arrangements have been approved in writing, all COD amounts-including additional charges-must be paid in certified funds only.

Condition at Delivery / Claims Signing
WAC’s or its agent’s Bill of Lading at destination without notation of damage constitutes conclusive evidence of satisfactory delivery. All claims must be submitted to WAC in writing within fifteen (15) days of delivery and must include photographs and a description of the specific damage claimed. Carrier shall not be liable, directly or through subrogation or assignment, for any payments made under the owner’s insurance while the vehicle is in Carrier’s possession.

Modified Vehicles
WAC and its agents shall not be responsible for damage arising from vehicle modifications, including but not limited to lowered or lifted suspensions, aftermarket wheels or tires, oversized or undersized tires, ground-effects kits, spoilers, or similar alterations.

Exclusions of Liability
WAC and its agents shall not be liable for damages not caused by their negligence. The Shipper agrees to submit such claims to its own insurer. Excluded damages include, without limitation:
a. Minor cosmetic damage (scratches, chips, scrapes) resulting from normal road conditions.
b. Damage caused by leaking fluids, battery acid, antifreeze, industrial fallout, road debris, acts of God, frame alignment, glass or tire damage, or overloaded vehicles.
c. Damage to exhaust systems.
d. Damage to convertible tops that are loose, worn, or torn prior to transport.
e. Damage to vehicle covers, bras, masks, caps, or similar accessories.
f. Damage resulting from the vehicle’s inability to be driven on or off the transporter under its own power.
g. Damage caused by tie-downs failing due to the vehicle’s age or condition.
h. Damage not visible due to the vehicle’s dirty condition at pickup.
i. Mechanical or electrical failures of any kind, including but not limited to engine, transmission, drivetrain, wiring, cooling systems, electronics, alarms, switches, alignment, wheel bearings, and suspension components.
j. Any rental car costs or other consequential or incidental losses.

Alarm Systems
The Shipper must fully disarm any alarm system and provide all keys or remotes. If an alarm activates, the driver may silence it by any reasonable means.

Vehicle Preparation
The Shipper is responsible for preparing the vehicle for transport. All loose, fragile, or protruding parts must be removed or secured. Any part that detaches during transport—and any resulting damage to other vehicles—shall be the Shipper’s responsibility.

Costs Resulting from Shipper Breach
The Shipper shall pay all costs arising from its breach of this Agreement, including storage, towing, and redelivery. The Shipper agrees to indemnify, defend, and hold WAC harmless from all losses, damages, expenses, and claims arising from such breach.

Delivery Times
Delivery dates and times are not guaranteed. All schedules are estimates only. WAC shall not be liable for losses or damages resulting from delays, including delays caused by weather, mechanical issues, or other unavoidable circumstances.

Pickup and Delivery Locations
Pickup and delivery will be made as close as legally and safely possible to the designated addresses. The driver has sole discretion to determine safe and lawful access.

Governing Law / Jurisdiction / Severability
This Agreement is governed by the laws of the State of Alaska. Any legal action arising from this Agreement must be filed in a court of competent jurisdiction within Alaska, and the Shipper consents to such jurisdiction. If any provision is found unenforceable, the remaining provisions shall remain in full force. This Agreement supersedes all prior written or oral agreements and may be amended only in writing by an authorized officer of WAC.

Carrier Authority
WAC is licensed by the U.S. Department of Transportation and holds Motor Carrier authority under USDOT Certificate No. 00125137.
Authorization to Operate Vehicle By signing this Agreement, the Shipper authorizes WAC and its agents to operate the vehicle for purposes of loading, unloading, parking, and transport between designated points.

Ocean Carrier Documentation
The Shipper or transporting carrier must document all damage before taking possession of the vehicle from the ocean carrier. Damage not noted on the ocean carrier’s paperwork will be denied for lack of documentation.

Damage Claims and Payment of Charges
All freight charges must be paid in full-without deduction-regardless of any dispute. Any damage must be noted at delivery while the driver is present. Claims must be submitted within fifteen (15) days with photos and two written repair estimates. If WAC is not the transporting carrier, liability rests solely with the carrier identified on the Bill of Lading. The Shipper agrees to pursue claims only against that carrier and to hold WAC harmless. All subcontracted carriers maintain insurance and DOT authority on file with WAC, available upon request.

Inoperable or Oversized Vehicles
Additional fees apply to inoperable or oversized vehicles, including vehicles that become inoperable after acceptance. Inoperable vehicles are transported strictly “As Is,” and WAC shall not be liable for any loss or damage relating to such vehicles.

Insurance and Fluid Leaks
While WAC or its agents are operating the vehicle for purposes incidental to transport, WAC shall have the benefit of any insurance maintained by the Shipper unless such coverage is void during WAC’s possession. The Shipper shall be liable for any damage caused to other vehicles by leaking fluids from the Shipper’s vehicle, including battery acid, coolant, or transmission fluid.

Vehicle Value Limitation
Bookings are limited to vehicles with a declared or actual value not exceeding One Hundred Twenty-Five Thousand Dollars ($125,000.00) per vehicle. WAC does not accept vehicles exceeding this value unless expressly approved in writing prior to booking. Any shipment tendered in excess of this limit without written approval may be refused or transported at the Shipper’s sole risk, with no liability assumed by WAC.

Stock Vehicle Requirement / Ground Clearance
Starting rates apply to stock vehicles only. Vehicles must maintain a minimum ground clearance of five (5) inches. Additional rates, special handling fees, or refusal of transport may apply to vehicles that are lowered, lifted, modified, oversized, or otherwise outside standard specifications.

Personal Effects (PE)
Personal effects are not permitted in vehicles unless the Shipper selects and pays for the Personal Effects (PE) add-on at a rate of $250.00 prior to shipping. Personal effects are limited to seven hundred fifty (750) pounds total. All items must be secured below window level and may not obstruct driver visibility or vehicle operation. WAC assumes no responsibility for loss, theft, or damage to personal effects. Firearms, ammunition, hazardous materials, flammable items, or illegal items are strictly prohibited.

Pricing and Rate Adjustments
All quoted pricing is subject to change prior to shipment based on, but not limited to, vehicle condition, dimensions (DIMS), ground clearance, operability, personal effects, pickup or delivery constraints, fuel level, seasonal demand, and carrier availability. Final pricing is confirmed only upon vehicle inspection and acceptance for transport.

Pickup Location Disclaimer
Pickup and delivery may occur at a central or alternate location when residential, commercial, or designated addresses are inaccessible, unsafe, or unlawful for transport equipment. The driver has sole discretion to determine the safest and most practical location.
